1. Introduction
These Terms and Conditions govern all quotations, supply, procurement coordination, sourcing and services provided by Alliance Mining Contractors Pty Ltd
By engaging our services or purchasing goods through Alliance Mining Contractors, the client agrees to be bound by these Terms and Conditions unless otherwise agreed in writing.
2. Scope of Services
Alliance Mining Contractors provides:
- Mining equipment sourcing and supply
- Spare parts and industrial component procurement
- Procurement coordination and supplier sourcing
- Export and logistics coordination
- Project-based equipment and materials supply
- Industrial and mining related supply services
We act as a procurement and supply partner sourcing equipment and components from manufacturers and suppliers globally.
3. Quotations
All quotations provided:
- Are valid for 14 to 30 days unless otherwise stated
- Are subject to supplier availability and confirmation
- May be subject to currency fluctuations
- Exclude taxes, duties and freight unless specified
Alliance Mining Contractors reserves the right to revise quotations prior to formal acceptance.
4. Orders and Acceptance
An order is considered confirmed when:
- A written purchase order is received, or
- Written confirmation is provided by the Client
Once confirmed, cancellation or modification may incur costs if suppliers have already been engaged.
5. Pricing and Currency
Unless otherwise agreed in writing:
- All pricing is in Australian Dollars (AUD) or USD
- Prices may be subject to exchange rate fluctuations
- Freight, insurance, customs duties and local taxes may be additional
Any variation in supplier pricing or freight costs may be passed on to the Client.
6. Payment Terms
Standard payment terms are:
- 100% advance payment for first-time clients, or
- 50% deposit and balance prior to dispatch, or
- As agreed in writing per project
Goods may not be released until payment is received in full unless credit terms are approved in writing.
7. Delivery and Logistics
Delivery timeframes are estimates only.
Alliance Mining Contractors is not liable for delays caused by:
- Manufacturers or suppliers
- Shipping or freight providers
- Customs clearance
- Port or transport disruptions
- Force majeure events
Risk transfers to the Client in accordance with agreed Incoterms.
8. Inspection and Acceptance
Clients must inspect goods upon receipt.
Any damage, shortage or defect must be reported within 7 days of delivery.
Failure to notify within this period will constitute acceptance of goods.
9. Warranty
Where applicable, equipment and parts are supplied with manufacturer warranties only.
Alliance Mining Contractors does not provide additional warranties beyond those provided by original manufacturers unless expressly agreed in writing.
10. Limitation of Liability
To the maximum extent permitted by law:
Alliance Mining Contractors shall not be liable for:
- Indirect or consequential losses
- Loss of production or profit
- Project delays
- Operational downtime
Our total liability shall not exceed the value of the goods or services supplied.
11. Force Majeure
We shall not be liable for failure or delay due to events beyond our reasonable control including:
- Natural disasters
- War or civil unrest
- Government restrictions
- Supply chain disruptions
- Transport delays
- Pandemics
12. Compliance with Laws
Clients and suppliers must comply with all applicable laws including:
- Anti-bribery and anti-corruption laws
- Trade sanctions and export controls
- Import regulations
- Environmental and safety laws
We reserve the right to refuse supply where legal or compliance risks arise.
13. Confidentiality
All commercial and technical information exchanged shall be treated as confidential and not disclosed to third parties without consent unless required by law.
14. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Australia unless otherwise agreed in writing.
15. Amendments
Alliance Mining Contractors reserves the right to update these Terms and Conditions at any time. Updated versions will be published on our website.
